SAM for Rights and Liberties stated that the continued prosecution of Yemeni journalist Hamoud Hazza and his referral to trial over the peaceful expression of his opinions and writings constitutes a troubling development that undermines freedom of expression and press freedom. The organization stressed that the measures taken against him should be reviewed in a manner consistent with the Yemeni Constitution and the country’s international obligations to protect fundamental rights and freedoms.

The organization reported that it has been closely monitoring the case, including the journalist’s detention in August 2025, his subsequent release, and his later referral to court, as well as the court’s order prohibiting him from publishing or commenting on the details of the case while the proceedings are ongoing. It noted that such restrictions impose additional limitations on his right to freedom of expression and emphasized the importance of safeguarding due process and the right to an effective defense.

It added that the documents circulated in connection with the case indicate that the charges are based on social media posts addressing matters of public concern. Such expression, it said, should be treated within the framework of the protection of freedom of expression, and criminal prosecution should be used only in the narrowest of circumstances and in accordance with established legal and human rights standards.

The organization further emphasized that press freedom extends beyond protection from arbitrary detention and includes safeguarding journalists against judicial proceedings that may restrict their professional work or create an atmosphere of intimidation and self-censorship. It stressed that expressing critical opinions or commenting on public affairs should not, in itself, give rise to criminal liability.

It also noted that the article at the center of the case presents a political comparison between two different periods in Yemen’s history and reflects the author’s personal political opinion. Such commentary falls within the scope of public debate, which enjoys heightened protection under international human rights law, provided that it does not amount to direct incitement to violence or hatred as defined by applicable legal standards.

SAM called on the judicial and prosecutorial authorities to ensure the independence of the legal proceedings, fully respect the defendant’s right to a fair trial, guarantee the defense team’s access to the complete case file, and lift any unnecessary restrictions on freedom of expression that go beyond what is strictly required to protect the integrity of the judicial process.

Finally, the organization reiterated its call on all authorities in Yemen to align national laws and practices with the country’s obligations under the International Covenant on Civil and Political Rights, in a manner that guarantees freedom of opinion, freedom of expression, and press freedom, while strengthening public confidence in the judiciary and the rule of law. It affirmed that protecting journalists and writers is a fundamental pillar of any society committed to upholding human rights and fundamental freedoms.
