
SAM Organization for Rights and Liberties stated that it strongly condemns the arrest of lawyer Salim Al-Allaw on 21 January by the Criminal Prosecution, in connection with a case related to publication and freedom of expression. SAM considers this measure a serious violation of freedom of opinion and a direct threat to citizens’ right to peaceful criticism and public accountability.
SAM affirmed that the authorities’ use of arrest powers and criminal procedures to intimidate activists, human rights defenders, and journalists constitutes a deviation from the state’s fundamental role and purpose. The state is expected to set an example in protecting freedoms and safeguarding free expression, not to become a party that restricts the public sphere and punishes expression by framing it as a “threat” rather than recognizing it as an inherent constitutional right.
The organization stressed that the arrest of lawyer Salim Al-Allaw on grounds related to publication contradicts the Yemeni Constitution, which guarantees freedom of opinion and expression and the citizen’s right to express views verbally and in writing. It also violates constitutional safeguards that prohibit infringement on personal liberty or its restriction except in accordance with the law and through sound judicial procedures, uphold the principle of legality of crimes and penalties, and reject the use of “public security” as a vague pretext to criminalize peaceful criticism. Moreover, this arrest breaches Yemen’s obligations under the International Covenant on Civil and Political Rights, particularly Article 19 on freedom of expression, Article 9 on the right to liberty and security of person and the prohibition of arbitrary arrest, as well as Article 14 concerning fair trial guarantees.
SAM emphasized that respect for the Constitution and relevant international human rights obligations requires ensuring that peaceful expression is not criminalized and that concepts such as “public security” are not misused through vague standards or personal discretion. Such practices undermine the rule of law, weaken public trust in justice institutions, and send negative signals regarding the state’s seriousness in protecting rights and freedoms.
Accordingly, SAM Organization for Rights and Liberties calls for the immediate and unconditional release of lawyer Salim Al-Allaw, the cessation of any punitive measures related to his work, opinions, or exercise of his right to expression, and the provision of clear guarantees to prevent the recurrence of such violations. The organization also urges law enforcement institutions to adhere to constitutional and legal standards in a manner that protects rights rather than confiscating them under broad and ambiguous pretexts.
